He added: Many bylaws and laws that required the presence of councils were drafted and approved without their presence, and even after the councils started working, some of these delays remained and their effects are still visible. Even in the latest law of the Islamic Council regarding the formation of sustainable income, which, although it was aimed at supporting the councils, the authority to make laws was taken away from the councils and assigned to the Ministry of Interior, meaning that the final decision-maker will be the Ministry of Interior, while According to the constitution, the existential philosophy of councils has been to be one of the pillars of decision-making.
Referring to the public and private meetings held with the members of the Guardian Council, Chamran clarified: the result of the meetings was that the Guardian Council only pays attention to one clause of the constitution, and that is that the councils must fulfill all these duties. with the cooperation of the government and other institutions. However, he did not pay attention to the principle that the councils are one of the pillars of decision-making, or elsewhere that the constitution stipulates that governors, governors, and prefects must separate the approvals of the Islamic councils of the cities if they do not conflict with the laws, and these cases in Their view is dim, therefore, decisions are made that are not in favor of the councils and the method and secretary they follow.
The head of the Tehran Islamic Council continued: “It is happening that the duties assigned to the councils are assigned to the Ministry of Interior, while the principle of the law was that the local people should have a direct role in the administration of their local affairs.”
He clarified: I believe that we should not back down, but we should continuously move forward and correct it, otherwise, unfortunately, the rights of the councils will be violated, of course, in the meetings with the members of the parliament, the judiciary, The Court of Administrative Justice and the Inspection Organization, which was held, said that regarding the issue of tolls, councils generally approve things that are not very appropriate and have not been considered and deepened enough. Referring to the tripartite meeting with the judiciary and the executive at the end of the fourth era, Chamran said: “We were supposed to reach a common point of view on taxes so that they will be reviewed and approved before they become effective.” Unfortunately, in the previous periods, the relationship between the councils and the two authorities was weak, but with the recent meeting with the Court of Justice and the Inspection Organization, the dialogue and communication opened up, and with the restoration of relations, these issues, especially the issue of parking lots and cutting down trees, which are difficult It will be prevented.
The head of the Tehran Islamic Council emphasized the position of the Guardian Council based on the existing laws regarding the issues of the council, and pointed to the issue of gardens and said: The laws related to gardens that were changed last year, unfortunately caused many problems. For example, in some cases, a document measuring 200 meters is brought to the court, and based on the name of the garden in the document, the council votes that it is a garden. These are the laws that should be amended to solve people’s problems.
He emphasized: Since the approval of this Law on Gardens and its referral to the Supreme Council of Architecture and Urban Planning in the Fifth Council of Tehran and its addition to the comprehensive plan of the city of Tehran, last year there has not been a single referral for construction in accordance with the said law. As we know, productive construction is the driving force of all the country’s industries and it includes many cases, so the country suffers harmful effects in this field. We all have to join hands so that the wheel of modernization starts moving in Tehran province, so surely by making the necessary reforms, the councils can be effective not only in solving the problems of the people but also in the prosperity of the economy of the people and the country.
Chamran continued by emphasizing that the main task of the Supreme Council of Provinces is to communicate with the government and the Islamic Council. Attendance in the parliament is really useful, appropriate and necessary for the council of provinces and it should be. Active presence is to be able to present appropriate plans and bills to the parliament, based on their approval, something can be done.
