Inflation shocks and rising exchange rates in the previous government put entrepreneurship in a tight spot

He added: “We do not expect the central bank as a commercial bank, but we know it as a policy-making bank in the field of money and banking.” We must ask the central bank to intensify its regulatory policies in favor of production and the economy.

The expert, stating that in the facility law, the bank is an entrepreneurial partner and economic activist, said: the bank should be with the entrepreneurs from the beginning to the end as a supporter.

He pointed out that banks should go beyond the mere view of an economic enterprise and put their power for the producer. There may be companies that take advantage of banking facilities and enter immediately if a breach occurs, but if we try to look at everything with one eye, we will never get the right solution.

“In the economic crime courts, we could not enforce the rulings in favor of entrepreneurs,” Karimi said. We need to amend and revise the law on banks and the payment of facilities.

There are good rules from the central bank for entrepreneurs

Continuing the roundtable, “Seyed Vahid Aghamiri”, a banking legal expert, stated: “Currently, the main problem for entrepreneurs with banks is to pay for the facilities they have received from the bank.”

He added: “There is a special court for entrepreneurs and producers called the 32nd special court for economic crimes, and its task is to follow up on people who have abused the facilities taken from the bank.”

The expert emphasized: Regarding the producers, good laws are being finalized by the Central Bank, one of which is the announcement of laws that if the production unit is in debt, it can not be easily closed. The bank retains its originality, which is to provide facilities to entrepreneurs, but what happens next, whether the exchange rate jumps, is no longer up to the bank.

Stating that banks have obligations to their depositors, he added: “The bank is the trustee of depositors and must gain the trust of its depositors by paying on time and correctly.” If depositors are to face various challenges after being granted any facility, depositors will no longer trust the bank and will face several difficulties in paying their interest.

Aghamiri suggested: strict and strict supervision should be done in providing facilities. If the supervision of the bank or the responsible institution is on the producers’ work process from the beginning, the losses of entrepreneurs and producers will definitely be less.

Businesses are becoming more complex

“If we have commercial courts that deal with this issue in a more specialized way, many,” said Abdullah Ahmadi, an entrepreneurship expert, noting that if the complexities of the law are reduced, Problems will be reduced.

“Businesses are becoming more complex now and they are legally different than in the past, so if we move to commercial courts, it can be a good thing,” he said.

Ahmadi stated: We should change our view of economic activists and entrepreneurs and have a positive view of them. Everyone should take responsibility for themselves and share in the profits and losses of productive activities.

The legal and judicial problems of entrepreneurs need to be investigated

In the continuation of this roundtable, “Hojjatullah Farzani”, an economic expert, stated: The legal and judicial problems of entrepreneurs and production units are divided into four categories. 18% of these problems are due to laws related to the tax administration. About 16 percent is related to social security, and the rest of this legal and judicial suffering is related to regulations.

He continued: “When critical situations arise in the country, they determine the rules that we should go through, but after leaving the critical situations, the rules remain in place.”

Farzani said: 9% of the problems of entrepreneurs are related to legal issues and have a significant share. When there is no market product and no desire for it, no matter how much it is supported and its problems are solved, it will not achieve success again.

The economist said: one rial of money that comes to the bank creates eight times as much liquidity and this money flows in the banking network. Liquidity is not bad at all if it moves towards the real sector of the economy.

He pointed out: If liquidity does not move during production, the lack of economic growth will also indicate this issue. Money is invested in unproductive and unrealistic sectors such as cryptocurrencies, and the current inflation is due to that.

The expert added: “Medium and small production units do not use legal advice and groups or organizations such as the Iranian Entrepreneurs Association can set up these legal consultations for production units and follow up on the legal issues of these units in the relevant institutions.”
