Mr. Fallahati, the respected chairman of the preliminary election committee of the Football Federation, on Monday, July 27, 1401, in a television interview on the “Top Football” program, before issuing the committee’s decision, made specific statements about the qualification of one of the election candidates, which strongly discredited him. In the situation of violation of impartiality, creating the suspicion of conflict of interest and clear deviation from the fundamental principles of fair proceedings. Therefore, I hereby announce my request regarding the necessity of the aforementioned resignation from membership in the primary election committee in order to maintain the integrity of the election process.
It is obvious that according to certain legal rules, no judicial, disciplinary and administrative authorities and authorities, including the members of the primary and electoral appeals committees and the members of the judicial bodies of the Football Federation, are allowed to investigate the issues and cases under their jurisdiction, before issuing Vote and comment. Therefore, referring to paragraph 10, article 20 of the constitution of the Football Federation, as well as article 2 of the election regulations, which oversees the obligation to avoid conflict of interest conditions during the election process for each of the members of the election committee, Mr. Falahati lacks the necessary qualifications to participate in the election. This period is the election committee of the Football Federation and it is necessary to act on the presence of the replacement member.
The gross defects in the performance of the honorable chairman of the election committee are to the extent that as one of the most obvious conditions of judgment, any prior consultation and comment on the case is considered as a reason for injuring the arbitrator, the lack of competence of the judge and the cases subject to rejection by the arbitrator, and this is important, for example, in para. Article 91 of the Civil Procedure Law and Article 421 of the Criminal Procedure Law are clearly stated.
I also request to check and make sure that there are no legal objections to the membership of Mr. Gerdani in the main composition of the members of the preliminary committee according to the regulations.
Based on the above, it should be noted that Mr. Fallahati does not have the legal authority to continue as a member of the preliminary election committee of this election period, to participate in the review of the candidates’ files, and to give an opinion on the final vote for the nomination of the candidates, and it is necessary to have another member. replace him instead.
Secondly, considering that his action is a serious and flagrant violation of the constitution and election regulations of the Football Federation, he has hereby announced his objection to file a case in the ethics committee of the Islamic Republic of Iran Football Federation and requested to investigate the cases of the aforementioned violations, which in addition to the cases The mentioned can be an example of the violation of Article 26 of the election regulations in connection with the violation of the principle of confidentiality and secrecy during the election process, I submit.
