A request from producers about home network contracts

The Association of Independent Cinema Producers of Iran published a text with tips for the contract of cinematographic works to be shown on the platforms of the home theater network.

Charso Press: Independent Producers Association asked producers to refrain from contracts outside the framework of professional rules.
The text of the Association of Independent Producers of Iranian Cinema is as follows:
“Unfortunately, in some cases, we see that some platforms put the producers in special conditions and announce that if they do not agree and do not hand over all the rights, they will refuse to buy the home show rights!
The Association of Independent Cinema Producers of Iran requests the producers not to enter into contracts outside the framework of professional rules under any circumstances.
Therefore, in order to preserve the rights of film producers and maintain the contracts of the group and the contract of the film works to be shown on the platforms, some points are reminded to the film producers:
1- The date of the contract for showing on the platforms is a maximum of three years from the start of the show in the home theater.
2- Be sure to pay attention to the word “exclusive” in the contract. The figures of exclusive contracts are definitely more than non-exclusive contracts, and by signing an exclusive contract, you will not have the right to transfer to another platform.
3- The geographical scope of the contract is only within the country. If the planform of the contracting party is willing to enter into a contract outside the country, a separate contract should be drawn up according to the planform’s foreign currency income from cinematographic works.
4- Avoid assigning copyright in contracts. The copyright of the film must be done by the producer and in the name of the producer. If the copyright is assigned, the film will be registered in the name of the platform and the platform will own the copyright of the film.
5- The YouTube contract is not dependent on the platforms in any way, and avoid handing it over to internal platforms. It is noteworthy to mention that some films will lose the possibility of sales and distribution and participation in festivals in the world arena by uploading them to YouTube.
6- Refrain from ceding the rights of television, airline, satellite channels in contracts.
7- The platforms are required to respect the intellectual rights of the authors, to include the name of the producer and director on the title of the film.
8- No planform has the right to cut, shorten, add and change in cinematographic works.
9- The production of a mini-series from a movie requires a separate contract, and no producer can serialize the movie version without the permission of the producer.
10- The contract for the purchase of cinematographic works is based on the ownership issued by the cinematographic organization, and every contract must be signed by all the owners. This means that the producers should introduce all the investors as parties to the contract and refrain from accepting the responsibility of the rights of the owners in the contract.
The Association of Independent Producers requests the respected producers to strictly refrain from signing the contract in case of non-compliance with any of the stated points and inform the association so that appropriate action can be taken. It is obvious that the reported violations will be followed up by the legal committee. took
