According to Tejarat News, in the past week, there have been new movements regarding the change in the status of construction in the gardens by the decision-making elements of the city.

According to Dunyay Ekhtaz, last Sunday, an emergency project called “Proposal to amend the Executive Regulations of the Law on Preservation and Expansion of Gardens to the Supreme Council of Provinces” was approved in the Tehran City Parliament, and last Thursday, during the meeting of the Supreme Council of Provinces, the first step to review this The offer was withdrawn.

However, everything is still only as an idea and proposal on paper and, according to the decision makers, it needs expert review and hammering; But what has been clarified so far from the dimensions of this story is that if the mentioned article is amended, the fate of gardens with an area of ​​less than 500 square meters located within the city limits will be changed in terms of construction rules.

The proposal to amend the mentioned article is important because according to Mehdi Chamran, the head of Tehran City Council, until the beginning of last year, the law did not have a plan regarding the status of gardens with an area of ​​less than 500 square meters and practically does not count them as “gardens”.

Of course, there was concern about preserving the trees of these lands; However, there was no specific provision in the law regarding whether they are gardens or not. Therefore, the city council is seeking to submit a proposal to amend a part of the aforementioned regulation to the Supreme Council of Provinces.

Since the Supreme Council of Provinces is chaired by Parviz Sarvari, the vice-chairman of the Tehran City Council, the issue was urgently raised in the meeting of this Supreme Council last week.

Sarvari believes that the previous wrong decision in the Tehran City Council regarding the gardens has caused the owners to not step forward to obtain a construction permit despite their desire to use the land, and in the past month not even a single request for construction in the gardens has been received.

From his point of view, this issue is caused by the lack of a logical relationship between the garden and the owner of the garden in the existing regulations. The Supreme Council of Provinces is trying to act in a way that establishes a logical relationship between the preservation of gardens and the interests of the owners in order to prevent the possible destruction of gardens with the motive of profit.

Sarvari added: We should certainly have amendments in this field considering the need to identify the type of garden. Therefore, it was decided that lands with an area of ​​less than 500 square meters will be excluded from the investigation in the Ali Shura court, in order to create a space that, in addition to preserving trees for the maintenance of gardens, will also provide the basis for obtaining a construction permit. Of course, there is no doubt that this resolution will be implemented in such a way that we do not cut any trees and at the same time, the land owner will also benefit.

Sarvari continued: We will try to reach a logical system to expand the gardens and make them profitable for the gardeners and owners with a comprehensive and scientific investigation along with the pathology of the past. In this regard, we will take advantage of all available experiences.

He emphasized: In the next meetings of the Supreme Council of Provinces, the necessary decision will be made regarding the approval of the gardens or khanebaghs in order to reach a comprehensive plan. But in the 9th meeting of the Supreme Council of Provinces, the first step was taken in this regard.

Emphasizing that in the past we have faced many ups and downs in the field of gardens, Sarvari said: In the past, for gardens under 500 square meters, a 15% construction permit was given, which means that only one room could be built in them; Of course, this issue does not provide the same conditions for the whole country.

Therefore, its dimensions in different cities should be examined and paid attention to. According to the chairman of the Supreme Council of Provinces, the level of occupancy in gardens under 500 square meters will be examined in the future meetings of this council.
