Deputy Speaker of the Parliament: The Guardian Council will probably reject the decision to increase the retirement age



Referring to the parliament’s approval during the review of the 7th Development Plan bill regarding raising the retirement age, he stated: According to the current law, the retirement age is 30 or 35, and we have two forms of retirement. For example, the service years of armed forces employees is 30 years, but in some government agencies it is 35 years.

He stated: Parliament and the government cannot change the retirement age halfway and this is against the constitution and sharia law. Based on this, we hope that the Guardian Council will show sensitivity to this issue.

Zul Nouri continued: A person who enters an organization or an office for your sake knows from the very beginning and based on a rule that he must serve for 30 or 35 years, so the government and the parliament do not have the right to tell the employees in the middle of the way how many more years they have to serve. They should be added and I consider this issue against Sharia and the constitution.

The Vice-Chairman of the Islamic Council said about the staggered increase in the retirement age based on the parliament’s resolution: Even if this is a staggered resolution, this is against Sharia and the Constitution, unless people are satisfied with continuing to cooperate with their group and in The Holy Quran has emphasized on the satisfaction of the parties.

He emphasized: I believe that the decision to increase the retirement age should be voluntary, and on the other hand, individuals and the government should be allowed to do so, in such a way that if that person wants to continue his service after retirement, that is, after 30 or 35 years to work again, this happens and there is no compulsion in this matter.

The representative of the people of Qom in the Islamic Council added: The person who is about to retire should see his own interests. In fact, if the benefit of the government is to continue the work of the employees, then the interests of those people should be considered and they should accept that their service period should continue and this should be done with their consent.

The Vice Chairman of the Islamic Council emphasized: The government and the parliament cannot unilaterally make a decision in this field and assign a duty to a person who is nearing the end of his service, that he should continue his service. My request is to the Guardian Council to be serious and sensitive to this matter.

He stated that I voted against this clause during the review of the issue of raising the retirement age in the parliament, and stated: I consider the increase in the retirement age to be a violation of the rights of people who do not want it to be added to their service period and from the beginning and based on the previous contract. A certain date has been set for their retirement.

Zul Nouri stated: We have strong legal and religious grounds for rejecting the resolution to increase the retirement age, and I think the Guardian Council will pay attention to this issue and this resolution will be rejected.
