According to the letter, in implementation of Article 123 of the Constitution of the Islamic Republic of Iran, the Law on Housing Production Leap, which was submitted to the Islamic Consultative Assembly under the title of “Duality Plan for Housing Production and Housing Level”, was approved in a public session on Sunday, 17th. August this year and the approval of the Guardian Council, will be announced in the appendix.
Funding for housing construction
According to Article 1 of this law, the government is obliged to meet the annual housing needs of the country based on the announcement of the Ministry of Roads and Urban Development based on studies of the comprehensive housing plan in urban and rural areas and to plan and act in the first 4 years of implementation of this law , To produce and supply at least one million housing units in the country annually.
Also, the “Supreme Housing Council” in order to plan, policy, monitor and coordinate between the executive bodies in the field of housing with the composition of the President (Chairman of the Council), First Vice President (Vice President), Minister of Roads and Urban Development (Secretary of the Council), Ministers of Energy, Interior , Industry, Mining and Trade, Economy, Cooperation, Labor and Social Welfare, Agricultural and Oil Jihad, Governor of the Central Bank, Chairman of the Planning and Budget Organization, Chairman of the Housing Foundation of the Islamic Revolution and a member of the Civil Commission of the Islamic Consultative Assembly The election of the parliament (as an observer) is held.
The Ministry of Roads and Urban Development is obliged to review the “Comprehensive Housing Plan” and approve it by the Supreme Housing Council no later than 3 months after the entry into force of this law.
Also, the Ministry of Welfare is obliged to cooperate with the Ministry of Roads and Urban Development in proportion to the resources available to the National Housing Fund. Welfare of Iranians, with priority given to families with at least three children under the age of twenty-five in the lower income deciles of families covered by the Relief Committee and the Welfare Organization and Disabled Veterans, and approved by the Supreme Housing Council.
Establishment of the National Housing Fund
Pursuant to Article 3, the “National Housing Fund” shall be formed with the function of aggregation and allocation of financial resources subject to this law, up to three months after the entry into force of this law, in order to create augmentation, strengthen support capacity and optimal allocation of financial resources.
The resources of this fund are from the sources obtained from the transfer of the lands subject to this law and the collected sources related to the 99-year lease, taxes related to land, housing, real estate and construction, resources provided for the housing sector in the annual budget laws, resources from the return of the original And Mehr Housing credit lines subdivision, repayment installments of the First Housing Savings Fund each year, charitable contributions and other resources provided in the fund’s articles of association are provided and used by the fund, including interest on subsidies, discounts on the issuance and renewal of building permits. Certificate of completion of the building, costs of providing and transferring infrastructure and participation in the creation of facilities, superstructure services and non-profit uses (educational, religious, medical, green space, cultural, sports, urban equipment) in urban development created in accordance with the model approved by the Supreme Housing Council The subject of this law is allocated for residential plan (project).
20% of bank facilities for housing
Banks and non-bank credit institutions are required to allocate at least 20% of the payment system of the banking system to the housing sector each year at the interest rate approved by the Monetary and Credit Council. In the first year of law implementation, the facilities for the units subject to this law are not less than at least 3 million and 600 thousand billion Rials (360 thousand billion Tomans) and for the coming years, the minimum resources of the mentioned facilities will increase by increasing the above percentage according to the annual inflation rate. Specialized banks are excluded from the provisions of this article at the discretion of the Central Bank, except for the Housing Bank. The above facilities are paid based on the annual housing needs in the plans and programs announced by the Ministry of Roads and Urban Development. In case of combining the resources of Bank Amel with the resources of National Housing Fund, the interest rate of the facility is calculated based on the ratio of the share of resources of National Housing Fund with Bank Amel and based on the interest rate approved by the Monetary and Credit Council.
Facilities related to the construction of units of this law will be converted into installment sales after the participation period and its obligations will be transferred to the buyer. The total period of participation and installment sales is 20 years. If the increase in the length of the construction period is due to the negligence of the builder, the profit of the participation period of the increased period is the responsibility of the builder with the approval of the Ministry of Roads and Urban Development.
Banks and credit institutions are allowed to issue mortgage bonds within the framework of the Central Bank regulations in case of payment of the facilities subject to this Article. Mustankaf, take it and deposit it in the treasury of the whole country. This amount is considered 100% allocated and is deposited in the account of the National Housing Fund.
99-year lease of land
The Ministry of Roads and Urban Development is obliged to implement the support programs for the transfer of lands required for housing construction on a 99-year lease. Earth Day expertise is determined at the beginning of the year of assignment (whichever is less).

The Forests, Rangelands and Watershed Management Organization is obliged to hand over the national lands located in the city limits as well as the lands approved by the Ministry of Roads and Urban Development for urban development projects outside the cities within 2 months.
The Ministries of Energy, Oil, Roads and Urban Development, and Communications and Information Technology are required to provide the necessary infrastructure in the area of their inherent duties in these lands.
Government agencies to hand over their lands
All government ministries, institutions and agencies, as well as companies whose 100% (100%) capital and shares belong to the government, are obliged to transfer and deliver lands at their disposal free of charge within the framework of location (6) of the Law on Organization and Protection. Production and supply of housing approved on 2/25/2008 (with the exception of the four areas under the management of the Environmental Protection Organization), within two months from the date of entry into force of this law at the request of the Ministry of Roads and Urban Development.
Supply of construction materials
In order to cover the risk of housing construction, the Ministry of Economic Affairs and Finance is obliged to provide the possibility of pre-purchase and other tools to cover the risk of purchasing construction materials (only steel and cement) in the commodity exchange.
Lump sum tax of one million Tomans
The Tax Affairs Organization is obliged to calculate the taxes on preparation, landscaping, infrastructure and superstructure and construction of housing for all housing support programs at the equivalent of one million Tomans per housing unit.
In order to monitor the housing market, it is necessary to enter all transactions of purchase, sale, pre-purchase, pre-sale, mortgage and rental of housing in the real estate transaction registration system of the country and obtain a tracking code.
