Stating that transitional meetings with the judiciary and Guardian Council lawyers have been held to invalidate affidavits, the legal deputy of the president clarified: The supreme leader of the revolution had emphasized this issue in a private meeting with the head of the judiciary when he was the head of the judiciary. Stay away from normal real estate transactions.
Dehghan added: Deprivation of credit from informal transactions of immovable property, which has been pursued by the government, the judiciary and the parliament for some time, was emphasized by the supreme leader of the revolution in recent days, and it will probably be realized after many years with the proposal of the Expediency Council. .
He continued: For years, experts and some officials have been talking about the problems of informal transactions and promissory note properties. The general view of the 13th government and the judiciary is to recognize official documents as valid and invalidate unofficial property documents. Some time ago, Mehrdad Bazarpash, Minister of Roads and Urban Development, told ISNA in this regard: Declaring normal documents illegal is necessary to prevent speculation in the housing market, and it is currently being followed up in coordination with the Expediency Council.
Legal Deputy of the President: The proposal to require the official registration of real estate transactions has been rejected twice by the Guardian Council. The council considers these transactions to be invalid and against Sharia standards.
It should be mentioned that this issue has been raised again by the government and parliament in recent months, and now it is awaiting the decision of the Council for the Determination of System Integrity as an important and challenging resolution.
In this regard, the judiciary agrees with the government. Some time ago, Hojjat al-Islam wal-Muslimin Mohseni Ajei said about the accreditation of official documents and the removal of accreditation from ordinary documents, that in this regard, we have consulted with the Supreme Leader, the Guardian Council and the scholars of Qom, and we have emphasized to them that the current situation regarding the accreditation of ordinary documents has innumerable complications. has it.
The leader’s emphasis on removing unofficial documents
Three days ago, the Leader of the Revolution called unofficial transactions of immovable property one of the major sources of corruption and stressed: “Such transactions should be discredited, and even if there is an objection to the approval of the Parliament from the point of view of the Guardian Council, it is in the best interest of the country.” And the system is the final approval of this law.
Following these wise words, government officials and some MPs emphasized the need to discredit unofficial documents. Mehrdad Bazarpash – Minister of Roads and Urban Development wrote on social networks: “The wise opinion of the leader of the revolution about the validity of official documents against the corruption of ordinary documents is a historical unraveling in the organization of the housing market.”
Hojjat al-Islam Hassan Nouri, a member of the legal and judicial commission of the parliament, also said: According to the Supreme Leader’s opinion, the parliament insisted on the necessity of discrediting normal documents in the plan of crediting official documents and not crediting normal documents. After the passing of several years, the Expediency Council will decide on the task of this project.
