How should the rental agreement be registered? – Tejarat News


From now on, residential real estate lessors must register the real estate lease contract through notary offices in the electronic document registration system or in the country’s real estate transaction registration system.

According to Tejarat News, the representatives of the Islamic Council approved Article 4 of this plan in a public meeting today (Monday, June 8) and during the review of the Construction Commission’s report on the two-urgent plan to control and organize the rent of residential properties.

According to this resolution, the following text is added as Note 9 to Article 169 of the Direct Taxes Law:

Note 9:

1- The Ministry of Roads and Urban Development is obliged to complete the national real estate and housing systems and register the country’s real estate transactions by using the information of official documents available in the electronic document registration system, in cooperation with the country’s real estate registration organization, and prevent Record information contrary to official documents (if any) in their systems. From the date of approval of this law, the criteria for renting a residential unit is the information registered in the country’s real estate transaction registration system.

2- Residential real estate lessors are required to register the real estate lease contract through notary offices in the electronic document registration system or in the country’s real estate transaction registration system. In case of concluding or renewing lease agreements conditional on loan or lease without registration in the aforementioned system or registration of false information as determined by the judicial authority, the lessor is not subject to the tax exemption subject to Note (11) of Article (53) of the Direct Taxes Law and accepting the claim Evacuation is subject to the payment of rental income tax under Article 53 of the Direct Taxes Law and fine under Article 192 of the Direct Taxes Law. Also, fifty (50) percent of the rental value of the property subject to Article (54) of the Direct Taxes Law is added to the legal fees during the contract period.

In case of concluding a contract by real estate consultants, failure to register the contract or registration of false information in the country’s real estate transaction registration system, in addition to the legal liability resulting from failure to register information, it is an example of income concealment and related crimes in Article 192 of the Direct Taxes Law and Off-line supply is the subject of Article 61 of the Trade Union Law of the country approved 24/12/1382 with its subsequent amendments and additions, and the government penal organization is obliged to deal with wrongdoers.
