Satra group (affiliated to Sedavsima), which is an institution that does not have an organization law approved by the Islamic Council, in a strange and illegal action to interfere in the union affairs of private businesses by launching a group called “Rasta” from some online display platforms He was invited to participate in a commission with the purpose of issuing production and display licenses and forming a trade union assembly, while in accordance with the fundamental principle of “no jurisdiction” in public law, “no administrative authority has jurisdiction, no initiative and action, including the issuance of instructions, regulations and It does not prevent the legitimate rights of natural and legal persons, unless the law has given him such permission.
As a result of this principle, the Satra group does not have the authority to intervene in the union and form a self-proclaimed group like Rasta. In addition, after years of activity, it still has not provided any comprehensive and accurate and acceptable definition regarding “surrounding audio and video” and due to the lack of a clear and approved law, therefore, there is no responsibility towards Satra in this area, let alone forming A special parallel guild with special and non-transparent motives!
On the other hand, despite the multi-year efforts of the Broadcasting Organization to legitimize Satra by including a line in the budget law, the honorable Guardian Council has always intelligently rejected it, as it contradicts Article 52 of the Constitution, but it is still not clear that Satra is without With what intention does the legal authority seek to form the Rasta Group and intervene in trade union affairs and perform the duties specified for the private sector!
Also, based on paragraph “b” of article 92 of the law of the sixth five-year program of economic, social and cultural development, the Ministry of Culture and Islamic Guidance, the Broadcasting Organization and other related institutions are obliged to comply with the general policies and the law on the implementation of the policies of Article 44 of the Constitution, the list of licenses and hand over cultural and artistic enterprises to the private sector, cooperatives and non-governmental organizations in accordance with Sharia standards.
According to Article 2 of the regulation of the said paragraph, all the licenses and management affairs of cultural and artistic activities, audio and video, written, non-written and digital media, cinematographic, visual and listening activities are considered the subject of this law. According to this, by violating the rules of public law and without the permission of the Islamic Council, he cannot be involved in business and trade union activities.
Especially, the high officials of the country have repeatedly stressed and seriously demanded the necessity of not taking over the public sector and facilitating affairs in private businesses, which happened to be emphasized by the 13th government as well.
In addition, according to Article 3 of the law on continuous improvement of the business environment, executive bodies are obliged to take into consideration the opinions of relevant economic organizations while developing or amending regulations, directives and executive procedures. According to this law and since the trade association of online video display, which was formed based on article 131 of the labor law and is currently the only legal representative of online video production and display businesses; Regardless of whether Satra has the permission to form such a commission or not, instead of entering into trade union issues and creating an organization called Rasta, it should invite this association to carry out matters related to the representation of the private sector. Not only has such an event not happened now, but a group that, first of all, is a competitor of the private sector with extensive facilities, and secondly, it is considered one of the governing bodies with public funds of the country, intends to form a guild for the private sector (!) and for this action, it is also publicly It refers to incentive packages in the sense that in order to legitimize or increase participation in the mentioned forum, it also promises the use of government facilities for members!
Based on this and considering the similar bitter experiences and the blows that the unnecessary intervention of the government departments in trade union affairs has inflicted on the private sector businesses and has always been condemned by the country’s highest authorities, we demand the cessation of this illegal act of satra and the consequences and costs We warn against the illegal and anti-union spirit of the country.
