According to the economic correspondent of Fars news agency, informal transactions relying on ordinary documents known as contracts are considered to be one of the most important weaknesses of the country’s governance structure, where any policy in the country’s economy can be rendered ineffective by the validity of ordinary documents and contracts. .
For example, suppose that the government intends to organize this market through the identification of housing owners in the country, in such a situation, the presence of contracts and registration of informal transactions is considered an obstacle to the formation of such a structure.
On the other hand, normal documents provide one of the most widespread corruptions in the country, namely land grabbing, which gives a big blow to the productive sector of the economy. In order to follow up on the impact of the normal document on Iran’s economy, we went to Sajjad Taheri, a judicial expert, and I asked him about how to make a profit through the sale of land in the way I had experienced.
Pointing out that any unauthorized change of land use is considered as land grabbing according to the law and can be followed up, Taheri said: “Our country has been struggling with the phenomenon of land grabbing for years due to the weakness of the laws and the increase in the price of land. “
This judicial expert explained how the phenomenon of land grabbing is profitable and said: The mechanism of land grabbing includes the stages of property seizure, walling, separation and sale with affidavit and normal documents, it will bring between 300 and 1000 percent profit to the market trader.
A lot of profit from the phenomenon of land grabbing goes to the trader’s pocket while his work is done without any legal risk, and the problem called the credit of ordinary documents will also reduce the risks of the land sale route.
* Necessity of entering the country’s judicial system into the phenomenon of land grabbing
In order to further investigate the dimensions of land grabbing in the cities and villages south-east of Tehran, such as Pakdasht and Varamin cities, we went to the residents of these areas. One of the residents of this area, referring to the lands attacked by land grabbers, said: There are countless pieces of usurped land with an area of 18,000 square meters, 20,000 square meters, etc.
This villager, referring to the wide dimensions of violations in the rural areas of Pakdasht and Varamin, said: In addition to land grabbing, we are witnessing the phenomenon of electricity theft and water theft from the public treasury sources, which are carried out by these people.
Referring to the land usurped by land grabbers, he said: If you visit the rural areas between Pakdasht and Varamin cities, you will notice the amount of usurped land, for example, a plot of land in the area of high voltage power transmission towers was attacked by land grabbers. has taken
Pointing to the reasons for the silence of the village councilors and other supervisors, he said: “Unfortunately, we are witnessing the footprints of councilors and other institutions in most of these land grabs.”
* The demand of the Minister of Economy on the issue of discrediting ordinary and power of attorney documents
It was before that Seyed Ehsan Khandozi, Minister of Economic and Finance Affairs, in a letter to the Chairman of the Expediency Council, demanded to speed up the approval of the plan of “discrediting ordinary and power of attorney documents” in this council.
In the text of this letter, it is stated: Validating real estate transactions through normal documents has led to a lack of economic transparency and as a result of widespread tax evasion in the large real estate market; According to many economic experts, as well as the group of this ministry, only one factor can force people to register their property information, and that is the creation and strengthening of the “guarantee of execution through the annulment of normal transactions”, otherwise the logic is clear. The economy of these merchants will not allow the introduction of real estate and its official registration. This implementation guarantee is effectively foreseen in the “plan to require the official registration of real estate transactions” which is currently being reviewed by that assembly.
* Invalidation of normal documents and punishment of land grabbers are on the agenda of the judiciary
The investigations carried out in this field indicate that the phenomenon of land grabbing is a complex issue, the fundamental prevention of which should be on the agenda of the country’s regulatory institutions such as the judiciary.
In this connection, Sajjad Hosseini, an expert in the field of housing, in an interview with Fars reporter, in explaining the solutions to combat the phenomenon of land grabbing, said: the validity of promissory documents has become a bane of the country’s economy due to the creation of a platform for corruption such as land grabbing, money laundering, and even tax fraud. . Therefore, discrediting these documents and increasing the validity of official documents is the main way to fight the mentioned corruptions in the country.
In this connection, the Leader of the Revolution, in a meeting with the officials of the country’s judiciary, called the unofficial transactions of immovable property one of the major sources of corruption and emphasized: such transactions should be discredited, and if it is objectionable from the point of view of the Guardian Council, it is expedient. The decision of the country and the system is the final approval of this law.
It seems that in addition to fundamentally solving the problem of land grabbing and other corruptions of this kind by using the invalidation of normal documents, the fight against all natural and legal persons who try to earn money through illegal means should also be placed on the agenda of the regulatory bodies to Let’s witness the eradication of this phenomenon in the country.
