According to Mehr News Agency, quoted by AFP, the US Supreme Court on Wednesday rejected part of the arguments of a Turkish bank that it has state immunity and refused to protect this bank from criminal charges due to “violation of Iran sanctions”.
According to this news agency, Halk Bank of Turkey had argued that the American federal law, known as the Foreign Sovereign Immunities Act of 1976, grants foreign countries absolute immunity from criminal prosecution in American courts.
According to this media, the bank further announced that the American federal courts do not have jurisdiction over this case.
Brett Kavanagh, the judge of this court, said in this connection: We disagree with Hulk Bank in both cases.
In 2019, a court in the United States rejected the appeal of a Turkish banker who was arrested and imprisoned on the pretext of violating Iran sanctions.
This court rejected the appeal request of Mehmet Hakan Atila, one of the deputy executive directors of Halk Bank Turkey, in the case of the alleged violation of sanctions against Iran, and claimed that the verdict against him was fair.
At the time, the New York District Court of Appeals for the Manhattan District declared that Mehmet Hakan received a fair trial after he was arrested in 2017.
He was arrested in the United States in March 2017 on charges of aiding in the circumvention of US sanctions against Iran. He was released from prison in the United States a few months later after serving most of his 32-month sentence and returned to Turkey.
