The discriminatory circular of the National Land and Housing Organization was invalidated – Tejaratnews
According to Tejarat News, the head of the legal deputy, public supervision and parliamentary affairs of the country’s inspection organization has requested the annulment of the circular number 7557-1400-600 dated 7-2-1400 of the National Land and Housing Organization, which for handing over land to the colleagues of that organization worth more than (one-third) prescribed the cost of construction, if this value is included for other applicants one-third, this circular was found to be contrary to paragraph 9 of the third principle of the constitution and was annulled by the general board of the Administrative Court of Justice.
It is worth mentioning that in the past and according to the circular number 53849/609 dated 28/10/1389 of the National Land and Housing Organization (under the directives for providing housing for employees in the form of Mehr housing), the value of each square meter of land assigned to employees without housing in the ministry road and urban development in the form of a 99-year lease) should be less than one-half of the construction cost of each square meter of residential space, while this indicator is set at one-third for areas that can be assigned in the National Housing Action Plan.
In the said vote; Firstly, according to Article 9 of the Third Article of the Constitution of the Islamic Republic of Iran, eliminating unfair discrimination and creating fair opportunities for everyone in all material and spiritual fields is one of the duties of the government of the Islamic Republic of Iran, and the complaint is the regulation that is between the employees of the Ministry of Roads and Urban Development and other members of the public. Due to the difference in the value of the assigned plots per square meter, it implies unfair discrimination and the falsification of this ruling and assigning it to the employees of the Ministry of Roads and Urban Development with the principles of the 19th and 20th of the Constitution of the Islamic Republic of Iran, which emphasizes the equality of the people of Iran with each other Yes, it is contradictory.
Secondly, considering that for the employees of the Ministry of Roads and Urban Development, according to the guidelines for providing housing for employees in the form of Mehr housing (approved by the National Land and Housing Organization on 28/10/2018), the price of each square meter of assigned land should be less than half of the price of building construction. It was considered residential.
This amount has reached one-third in the case of the National Housing Action Plan, and in the amendment of the aforementioned circular, which is the contested provision in this case, the above-mentioned ratio has been increased to one times (equivalent) the cost of construction, which is the above-mentioned triple ratio applied to the employees of the Ministry of Roads and Urban Development. For this reason, it is considered illegal discrimination.
Therefore, Circular No. 7557-1400-600 dated 7-2-1400 of the National Land and Housing Organization due to the contradiction with paragraph 9 of the third article of the Constitution of the Islamic Republic of Iran documented in paragraph 1 of article 12 and articles 13 and 88 of the Law on Organizations and Procedures of the Court Administrative justice approved in 1392 is revoked from the date of approval.
