The Ministry of Economic Affairs and Finance gave an explanation regarding the collection of tax penalties for non-payment of housing facilities from banks that are dissatisfied with the implementation of the Housing Production Jump Law: After the notification of the Housing Production Jump Law approved on September 3, 1400, the individual ceiling and quota of each bank for the first year of the implementation of the law A total amount of 3,600,000 billion Rials and the quota for the second year of implementation of the law is 4,580,000 billion Rials and the quota for the third year of implementation of the law is 6,590,000 billion Rials.

According to the report of the Central Bank, which was extracted from the relevant system in the Ministry of Roads and Urban Development, from the beginning of the housing production surge law until October 30, 1402, 1 million 852 thousand 220 units were introduced to the banks, but 1 million 21 One thousand and 194 applicants have applied to the operating banks, out of the total number of applicants, 139 thousand and 94 units have been found to lack the necessary conditions to receive facilities due to reasons such as lack of ownership documents, failure to bring the applicant and lack of collateral, and 882 thousand and 100 units It has been accepted that 261 thousand 517 people have not filed due to problems such as failure to return within 45 days, failure to provide financial statements and non-current debt records.

Based on this, 620 thousand 853 people have filed and 70 thousand 702 cases have not been approved due to reasons such as lack of completion of documents in the office, withdrawal of the applicant, etc. and finally 549 thousand 881 units have been approved in the office and Out of this number, 508 thousand 327 units have reached the contract conclusion stage and 428 thousand 861 units have been paid a total of 760 thousand billion Rials.

According to the mentioned cases and since access to the relevant system was not possible in the first year of the implementation of the law for most of the operating banks, with the exception of Maskan Bank, and on the other hand, the criteria for implementing the contracts with the quotas notified to the banks for tax collection led to an increase in the banks’ imbalance. Especially state banks, the deputy of banking affairs of the Ministry of Economy has suggested that this issue be re-examined by the Tax Affairs Organization.

What is the final fine of banks?

According to the law on the jump in housing production, banks and non-banking credit institutions are obliged to allocate at least 20% of the payment facilities of the banking system every year to the housing sector at the interest rate approved by the Money and Credit Council.

In case of non-compliance with this legal provision, the country’s tax affairs organization collects a tax equal to 20% of the unfulfilled obligation from the defaulting banks and credit institutions and deposits it into the country’s treasury in the form of the annual budget.

Accordingly, according to the recent statements of the Minister of Economic Affairs and Finance, a fine of 26 thousand billion tomans has been included for the offending banks in the field of granting housing facilities.

Referring to the President’s order in this regard, the Minister of Economy has said: Based on the report prepared on the performance of 25 banks until November 15 of this year based on the decision of the judicial review, 26,263 billion Tomans fines have been finalized for the offending banks.

Khandozi continued: The amount demanded from the delinquent banks in the payment of housing facilities based on the law on the jump in housing production is 61,600 billion tomans, for which 59,152 billion tomans have been awarded in the initial stage, and with the finalization of some of these Yes, the said fine of 26 thousand billion tomans will increase.

He further stated: So far, for Noor Credit Institution, Bank Day, Bank Saderat, Bank of Iran, Bank of Iran, Bank of Saman, Bank of Entrepreneurs, Bank of Pasargad, Bank of Sina, Bank of Shahr, Bank of Tourism, Bank of Parsian, Bank of Agriculture, Sepeh, Capital Bank and Postbank have been issued an appeal decision.

The Minister of Economy stated that the final decision has not yet been issued on Maskan Bank, Cooperative Development Bank, National Bank, Middle East Bank, Aindeh Bank, New Economy Bank, Mellat Bank, Refah Bank, and Tejarat Bank, that this issue will be done quickly and the final fine amount All banks will be announced soon.
