فارسمن | Why is the anti-rent bill of the parliament opposed? / A look at the statements of some officials of the judiciary regarding the elimination of judges’ rent

Fars Plus; Narration of the day: Last week, lawmakers in the 11th parliament passed a 60-year monopoly on bar associations and other monopolies, including formal expertise and notaries, with the passage of the Business Facilitation Facilitation Act.
Ending the rent and discriminating against MPs and judges to obtain a license to practice law without examination was another part of the resolution.
Previously, some judges, with thirty years of service or in some cases even before retirement, entered the field of advocacy to earn billions of attorneys; Some members of parliament, who, due to the title and the connections they made for themselves during their term in office, became the place of millions and billions of references after becoming lawyers.
What do the officials of the judiciary say?
The latest comment was made by a spokesman for the judiciary, who said the bill should have been considered by the parliament’s legal commission.
A spokesman for the judiciary said: “The judiciary acted in this regard with the help of the center, but it was suddenly raised in public and the judiciary had no information. The issue of advocacy has been discussed for a long time and is on the agenda, and there are bills and plans in the parliament. This proposal is in a law that has little to do with advocacy. This issue should be referred to the Legal and Judicial Commission and a comprehensive decision should be made with the help of experts. “The law specifies who will represent them.”
Earlier in the 10th parliament, a plan called “Comprehensive Advocacy Training and Admission” was announced, which with a more comprehensive view tried to amend all the rules of admission and advocacy training so that this field of work takes into account the interests of both the people and the judiciary. . However, the investigation of this plan was entrusted to a working group, which was responsible for a member of parliament who had a license to practice law, and ironically, he was disqualified in the 11th parliamentary elections and spent some time in the custody of security agencies. Under the leadership of this tenth member of parliament, the plan remained on the committee for more than two years and never even made it to the committee meetings.
The manner in which the head of the judiciary dealt with this issue was fundamentally different, and Ejei had suggested in speeches that the deputies use the expert opinions of the legal assistant so that the plan would not deviate from its main goal, be a pervasive society and would not cause discrimination.
How is Iran’s lawyer per capita in relation to its neighbors?
At present, according to many experts, Iran is even behind the countries in the region in terms of the number of lawyers. Iraq with 134 per capita, Lebanon with 129, Georgia with 232, Egypt with 159, Turkey with 170 and Kuwait with 148 lawyers per 100,000 population compared to Iran, which has only 89 lawyers per 100,000 population Yes, they are in a much better situation.
The result of this shortage of lawyers is a reduction in the level of public access to a lawyer, an increase in the price of attorneys’ fees, and as a result, the majority of people are deprived of legal services. As Mohammad Reza Kamyar, a member of the board of the Bar Association, put it in a statement:
“Some monopolies in the country have created a ‘class divide’, and we in the judiciary will seek to break these monopolies,” the head of the judiciary said in his first remarks at a meeting of the Judiciary Transformation Document.
Earlier, the Supreme Leader (Mudzalah Al-Aali) in a meeting with the leaders of the judiciary during the Judiciary Week and also in the text of the sentence of Hojjatoleslam Ejei had emphasized the implementation of the judicial transformation document. It seems that an important part of this transformation document can be realized in the same plan to facilitate the issuance of business licenses, which has been approved by the parliament.
