According to Mehr reporter, Mohammad Hossein Niromand, art and cinema adviser to the Minister of Culture and Islamic Guidance, in a note that he provided to Mehr news agency, while reviewing the circumstances of holding the 16th General Assembly of Cinema House, described this trade union wandering between two ministries.
This note states:
“The holding of the 16th General Assembly of Cinema House was accompanied by many words and hadiths. Doubts about the accuracy of the elections were first expressed on the same day of the election by some of the attendees of this assembly. However, the assembly decided not to postpone its holding to the next meeting and hold the elections.
In the last few days, some cinematographers and media have published a list of the violations of this assembly, so that the grounds for canceling the 16th election of Khaneh Cinema by official and legal authorities may be provided. The author does not intend to refer the dear reader to this list once again, rather he seeks to point out why this situation has arisen in the cinema house, so as to determine where the main origin of such words and hadiths comes from.
Today, the cinema house is in a complicated, ambiguous and undecided situation, which unfortunately the majority of the residents of this house are not aware of, and the few people who know are the ones who played the main role in the formation of this situation. In 2018, some members of this group, with the political support of government workers, aimed to distance themselves between the Ministry of Culture and Islamic Guidance and cinema guilds, and also in the name of legalizing cinema guilds, by presenting a hasty proposal without considering the nature of artists’ work and its obvious differences with professional activity. workers and more importantly with other current laws of the country, a resolution with the clause that “the natural persons of the phenomenon of bringing cultural and artistic works and employees of the culture and media sector can submit their application to the Ministry of Cooperation, Labor and Social Welfare for the establishment of a nationwide trade union in a specialized field “Give” in the Council of Ministers approved and implemented the wrong track that led to the current situation. According to the statutes of the Cinema House, this house is under the supervision of the Ministry of Culture and Islamic Guidance, while the cinema industry, as the highest pillar of the Cinema House, is under the supervision of the Ministry of Cooperation, Labor. and social welfare activities.
However, this question arises why the people who designed such a program for the cinema house did not put the cinema house under the support umbrella of the Ministry of Labor? For several reasons: First, in this case, the possibility of cultural and artistic activities for the cinema house would be denied, because according to the resolution of the Supreme Council of the Cultural Revolution, issuing licenses for the establishment of cultural and artistic centers and institutions is the responsibility of the Ministry of Culture and Islamic Guidance.
Second, according to the law of the Ministry of Labor, labor and employer associations are basically not allowed to set up collective centers composed of labor and employer classes together due to the conflict of interests. Therefore, in this situation, it was not possible for cinema producers to be present as employers along with other classes as workers. The acceptance of Cinema House under the support umbrella of the Ministry of Labor meant the departure of the producers as the most important film industry from Cinema House!
Thirdly, it was not possible to provide the financial assistance of the cinema organization, art credit fund and tax exemption to the labor union of the cinema house, while the main financial supporter of the cinema house in the last thirty years has been the Ministry of Culture and Islamic Guidance.
And fourthly, a small group of influential cinematographers who have reduced the cinema house to a political party for years are taking advantage of this uncertainty for their political and economic goals and agendas.
In order to get out of this fundamental and of course legal problem, it seems that there are currently two ways for the people of the cinema. Or that the Cinema House will continue to operate under the supervision of the Ministry of Cooperatives, Labor and Social Welfare from now on, according to the aforementioned explanations, and of course, considering that the Court of Administrative Justice in January 1400 The resolution of the Cabinet has also been annulled! It is unlikely that the people of the cinema house will follow this illogical path, or that they will follow and regulate their future activity based on the existing statute. Naturally, for the implementation of this path, the first task and of course the most important task is to fulfill the note of Article 1 of this statute. In this note, it is stated: “Cinema House member organizations are required to submit their request and the text of their statutes to the Ministry of Culture and Islamic Guidance and receive a receipt within one month after the notification of this statute, otherwise their membership It will be suspended in the cinema house”
It is surprising that since 1992, this note has not been followed up and implemented not only by the board of directors of Khane Cinema, but unfortunately outside of the constitution of this house, i.e. the provisions of the statutes of Khane Cinema, it has recognized the cinema trade unions identified by the Ministry of Labor as a general assembly. ! And it is funny that the guilds that have gone through the legal procedures of the Ministry of Culture and Islamic Guidance and obtained the activity license according to the existing statutes of the Cinema House, did not receive the permission to attend the Cinema House General Assembly in the two recent elections of the Cinema House!
With this explanation, it seems that the 5,000 members of the cinema house, who are the main victims of this uncertain and ambiguous situation of the cinema house, should play a more serious and active role in organizing and legalizing their house.”
