This year, the seventh grade entrance exam will be held at 9 am on Thursday, July 1, 1402, and the 10th grade capacity completion test will be held at 9 am on Friday, July 2, 1402.
In the handbook and the conditions for participating in the entrance exams of the first and second term high schools of high school talents, it is stated: ninth grade students of high schools of high talents, who have a minimum average of 18 in the month of June of the eighth grade and the first round of the ninth grade, do not need to participate in the entrance exam of the tenth grade. , will be allowed to continue studying in high schools of the second period of brilliant talents. The definitive acceptance of such students depends on meeting the conditions of Article 16 of the regulations of gifted schools.
But some time ago, following a complaint from the Ministry of Education and requesting the annulment of clause 5, section (d) of the instructions for the entrance examination of gifted schools, No. 501/104, dated March 19, 2019, regarding the admission of ninth grade students without participating in the tenth grade exam in schools. Brilliant Talents, the General Board of the Court of Administrative Justice, after discussion and investigation, considered the above-mentioned instruction to be an example of illegal discrimination and contrary to Paragraph 9 of Article 3 and Principles 19 and 20 of the Constitution of the Islamic Republic of Iran and annulled it.
In this opinion, it is stated: “According to paragraph 9 of the third article of the Constitution of the Islamic Republic of Iran, eliminating unfair discrimination and creating fair opportunities for everyone in all material and spiritual fields is one of the duties of the government of the Islamic Republic of Iran, and according to the nineteenth article of the Constitution, the people of Iran No matter who they belong to, they have equal rights and according to the 20th article of the constitution, all people of the nation, including men and women, are equally protected by the law and have all human, political, economic, social and cultural rights in accordance with Islamic standards. have
Based on the above and considering that row 5 of part “d-1) registration criteria and conditions” under paragraph (d) of the instructions for entrance exams of the first and second high schools for talented students in the academic year 1401-1401 (the subject of notification number 501 / 104, March 19, 2019, the head of the National Organization for the Development of Talented Talents) under the title of the criteria and conditions for the registration of candidates entering high schools of the first and second term of high school talents, regarding the possibility of enrolling and continuing the education of students in the ninth grade of talented schools without participating in the tenth grade, example Unlawful discrimination and not creating fair facilities for members of the nation.
Therefore, it contradicts the 9th paragraph of the third principle and the 19th and 20th principles of the Constitution of the Islamic Republic of Iran, and it is invalidated based on paragraph 1, article 12 and article 88 of the Law on Organizations and Procedures of the Court of Administrative Justice approved in 2013.
A number of audience members of Fars news agency registered a campaign titled “request to stop the second term exam of Sampad” and demanded follow-up; It is stated in this campaign: “News has recently been published that Sampad students have to retake the exam to enter the second period schools. This law has made many students and their families upset and worried. Taking an exam at any stage of education is a risky and stressful process. However, in this case there are many reasons why this law is not acceptable.
First, Sempad is an educational complex with very special classes. In other words, they have paid for studying in this collection. Now, with the issuance of such a law, it seems that Sampad has not been identified and approved as a quality educational complex.
Secondly, this law makes Sampad students feel discriminated. Why should only Sampad students retake the exam? Are there acceptable reasons to issue such a law only for this educational group?
