New news from the beginning of taxation of luxury houses


According to Tejaratnews, more than a year after the introduction of the luxury housing tax in the 1999 budget law and the inaction of the previous government, the tax regulations, which are also included in this year’s budget law, were approved by the cabinet yesterday.

Accordingly, residential units (including all buildings, including real estate, apartments and villas) and the garden of expensive villas (including realms and estates) belong to all individuals and legal entities and their dependents, with a daily value of more than 100 billion rials Also, the garden of the villa (places that are recognized as gardens according to the issued license and have been issued by the municipalities and villages according to the case of the construction permit of the villa) are the assets covered by this regulation.

Tax rates

According to this regulation, the annual tax rate of assets subject to the regulation (including realms and properties) for assets with a daily value of 100 billion and one rials to 150 billion rials compared to a surplus of 100 billion rials equal to 0.1 percent, from 150 billion and one rials Up to 250 billion rials compared to a surplus of 150 billion rials equal to 0.2 percent, from 250 billion and one rials to 400 billion rials compared to a surplus of 250 billion rials equal to 0.3 percent, from 400 billion and one rial to 600 billion rials compared to The surplus of 400 billion rials is equal to 0.4 percent and compared to the surplus of 600 billion rials is equal to 0.5 percent.

For example, to calculate the annual tax of a residential unit of 20 billion Tomans, after deducting 10 billion Tomans of tax exemption, 5 billion Tomans will be calculated at the rate of one thousandth and five billion Tomans at the rate of two thousandths, resulting in 15 million Tomans of annual tax. A residential unit is 20 billion tomans.

Taxpayers are required to pay taxes by February this year

This regulation stipulates that all owners of eligible assets are obliged to pay the annual tax subject to this regulation through the specified mechanism, no later than the end of February 1400. Otherwise, the country’s tax administration can collect the relevant tax through the executive operations specified in the law on direct taxes.

On the other hand, real estate registries and notaries are also allowed to register the transfer of property for which a tax has been imposed according to this regulation, before paying the transferred tax debt (including property tax, definitive transfer and rent). ) And the violator will have joint and several liability in paying the relevant tax.

The luxury home tax law is about to be implemented in a situation where yesterday the deputy head of the tax organization announced the implementation of another tax.

Masihi, the Deputy Minister of Tax Revenues of the Tax Affairs Organization, stated that the tax instructions for cyberspace activists have been prepared and announced: the tax claim is subject to the submission of a tax return for individuals and legal entities after the end of 1400 on time.

2 Ambiguity about the luxury home tax law

Although curbing speculation and rising prices with thematic tax instruments is widely accepted, two points need to be noted.

The first point is the legislative model in this regard. In situations where the law should be regulated in such a way that it can be extended to later years, the type of targeting in this law, by specifying the numbers, will have a more short-term function.

The second point goes back to the figures in the law. In a situation where in metropolitan areas, the rate per square meter of a residential unit is practically in the range of 10 million Tomans and more and in Tehran above 30 million Tomans, it does not seem that the figure of 10 billion Tomans is very luxurious with the residential unit in the mentioned areas. It should be appropriate and it is better that the figure set for Tehran and big cities is different from small cities.
