Presenting proposals about the bill “Improving security and preventing and protecting women against harm” to the parliament


According to Fars news agency’s judicial group, “Kazem Gharibabadi”, the deputy of international affairs of the judiciary and the secretary of the human rights headquarters of the Islamic Republic of Iran, said: the human rights headquarters aims to strengthen the text of this bill and prevent violence against women. He has submitted suggestions to the Social Commission of the Parliament and the Presidium of the Islamic Council in the following areas:

First, the need to comprehensively explain and prevent all types of “violence” or, in the words of this bill, “damages” that threaten women;

Second, the need to extend the protection of the bill to all Iranian women, even if they do not live in Iran, and also to extend it to all non-Iranian women who are victims of violence who are present in Iran, such as tourists or refugees;

Third, the provision of specialized branches to deal with cases related to this law and the presence of a female judge in criminal courts with a plurality of judges, depending on the case;

Fourth, the hearing of the reports of welfare organization employees in cases of harm against women and the immediate handling of cases raised by law enforcement and judicial authorities;

Fifth, the need to criminalize and determine punishment for crimes such as assault, any sexual harassment and harassment of women;

Sixth, the duty of the executive bodies to prevent secondary violence, in case women exposed to violence or victims of violence refer to those bodies;

Seventh, the need to provide a financial support fund for women victims of violence when the relevant accused is fugitive or unknown;
Eighth, the necessity of maintaining the confidentiality of all information on cases of violence against women and appropriate punishment for any person who commits the disclosure of this information.

It should be noted that the bill “Ensuring women’s security against violence” was drafted in 1390 by the Presidential Vice President for Women and Family in the 10th government, but due to its judicial nature, it was sent to the judiciary in 1396. After several stages Finally, this bill with the title “Enhancement of security and prevention and protection of women against harm” in December of this year, passed the review process in the Social Committee of the Parliament and is now waiting for the draft in the open floor of the Islamic Council.

This bill, while paying serious attention to the inter-institutional support of injured and vulnerable women, the necessary legal mechanisms and facilities to raise the status of women in the society, and the important issue of preventing women from being victimized.

The said bill aims to intensify the punishment of violators of women’s rights, including vulnerable women such as women under the age of 18, pregnant, lactating, sick, elderly, mentally or physically disabled, sensory and psychological, homeless and displaced, women victims of domestic violence, It provides legal and criminal protection to women who have no financial means, women who have been rejected from their place of residence, vulnerable women who have been abused, imprisoned women who are heads of the household and who have been subject to financial convictions for unintentional crimes.
