Ghamsarian proposed the establishment of a unified procedure for handling traffic accident cases across the country and the formation of specialized accident complexes, adding: “On the other hand, eliminating unnecessary processes in handling accident cases can also be helpful.”
The CEO of the Personal Injury Insurance Fund, emphasizing that the use of legal capacity for legalization in the insurance industry should be on the agenda, announced his readiness to make the process of handling cases related to the insurance industry and the Personal Injury Insurance Fund smarter.
Creating a suitable platform for mutual access to databases between the judiciary and the insurance industry to reduce people’s referrals is another solution proposed by Ghamsarian.
According to him, a proper judicial approach and an appropriate and deterrent approach to the perpetrators and offenders of traffic accidents can be achieved with the cooperation of the insurance industry and the judiciary.
Ghamsarian, stating that formal and fictitious accidents are one of the problems of the insurance industry, said: The judiciary, police, emergency services, forensics and the insurance industry can help. Appropriate judicial methods must also be adopted to prevent the occurrence of formal accidents that cause irreparable damage to the body of the insurance industry, and we in the insurance industry are willing to provide details of the proposed solutions to the judiciary.
The CEO of the Bodily Injury Fund continued to report the suspension of many effective laws in the field of accident reduction, especially the law on compulsory third party insurance during the last 6 years and said: One of the expectations of the Ministry of Economy (insurance industry and insurance fund) from dear prosecutors across the country As well as the National Inspection Organization, oversees the strict implementation of the law on compulsory third party insurance, from culture to the implementation of various executive requirements and guarantees.
Ghamsarian criticized the inefficiency of some agencies and said: “For example, the Ministry of Roads and Urban Development, law enforcement, transportation and fuel management headquarters have refused to perform their legal duties regarding damages to third parties due to accidents caused by vehicles and related regulations.” This has caused irreparable damage to the society, for example in the Mashhad-Yazd train accident, if the esteemed prosecutor takes this issue seriously, future accidents will be prevented.
Ghamsarian further explained some examples of the most important articles of the law on compulsory third party insurance, the exact and complete implementation of which is very necessary and appropriate but not implemented, and referred to Article 41 of this law and said: According to this article, the Ministry of Roads and Urban Development Since 2016, it has been obliged to create a “comprehensive system of traffic accidents” in accordance with the regulations with the participation of relevant agencies and to take action to continuously update and analyze the data. Unfortunately, this has not progressed.
He referred to Article 42 on confiscation of vehicles without compulsory third party insurance coverage as another suspended article and said: Considering the significant number of vehicles without insurance coverage in the country, the implementation of this legal article can avoid lawlessness. , Prevented the imposition of additional costs on the bodily injury insurance fund by the owners of the said vehicles, so that despite the legislator’s instruction to the traffic police in identifying uninsured vehicles through surveillance cameras, but unfortunately witnessed action We are not effective in this regard.
Also, according to Article 45, the provision of any services to vehicles without insurance is prohibited, while basically the insurance coverage of vehicles in the technical inspection centers is not effective in issuing the inspection certificate.
Unfortunately, in license plate replacement centers, despite the removal of the physical version of the third party insurance policy by the insurance industry, the image of the insurance policy is still required from the vehicle owner as necessary documents to perform license plate replacement matters, which is necessary due to the possibility of forgery. Image of the insurance policy, in this regard, any inquiries should be made from electronic platforms (Sanhab system).
Ghamsarian said: “The above cases are examples of explicit but suspended laws of the country, which if fully implemented, will play a significant role in developing the culture of insurance and preventing damage of several thousand billion to the country’s public resources.”
