فارس من | Celebrities and shooting in the dark / the need to use “Article 7” to pursue false claims

Fars News Agency Community Group; In recent days, some artists have made statements in cyberspace on the sidelines of the Cannes Film Festival, some of which can be considered criminal.

The speeches, which provoked the reaction of many people and cyberspace activists, were seen by some as a symbol of freedom of expression and others as a blackmail that could set fire to dissident media in the current situation and pave the way for Westerners.

But the question is, is the speech made by these artists legally criminal?

Some legal experts say that the prosecutor, as the public prosecutor, can enter the case on charges of disturbing public opinion and spreading lies without having a private plaintiff, while others raise other charges.

Of course, all these questions are raised with the assumption that none of these artists had the intention to express their content and only answered the questions raised without considering its legal dimensions.

In this regard, we talked to Mehdi Azizzadeh, a lawyer and university lecturer, to learn more about the details of this issue.

In an interview with a Fars reporter, he said: “If someone presents lies abroad or inside the country with the intention of disturbing the public mind, it is criminalized according to the law.”

The lawyer continued: “Some of the speeches that have been given abroad can include ‘spiritual pluralism’, meaning that an action is taking place; But it includes two criminal titles and it is not only spreading lies but also propaganda against the system.

According to this university lecturer, it is the prosecutor’s duty and duty to intervene if a crime has occurred and to prove the guilt of people who make untrue statements at foreign festivals.

He added: “Lying has been criminalized in two parts of the Islamic Penal Code in the form of” false testimony “and” spreading lies “with the intention of disturbing the public mind.”

Azizzadeh emphasized: According to Article 7 of the Islamic Penal Code adopted in 1392, anyone who lies outside Iran or inside Iran with the intention of disturbing the public mind is an example of Article 698 of the Constitution; And if it is abroad, it does not prevent it from being tried in legal courts.

He said: “These celebrities are not considered as representatives of Iran in foreign festivals;” Rather, they are known as famous Iranians.

The role of the Judiciary’s Deputy for Crime Prevention in the margins of the artistic community

In this regard, some legal experts also assign duties to the Judiciary’s Deputy for Crime Prevention.

Azizzadeh states in this regard: According to the duties defined for this deputy, sometimes people are ignorant of the law and can create corruption for the individual and society, so this deputy must take the necessary measures to prevent From the occurrence of a crime; Of course, it should be borne in mind that ignorance of the law is not acceptable 15 days after its publication in the official newspaper of the country.

In order to clarify the dimensions of this case, we went to the Deputy for Crime Prevention of the Judiciary, but unfortunately, the public relations of this deputy made the comment in this regard conditional on the words of the prosecutor. “We do not have an answer now,” he said.

Now we have to wait and see what will be the final reaction of the judiciary to the speeches made by some artists at the Cannes Film Festival?

Commenting, the type of clothing and appearance of artists in national and international festivals is not the end of their margins in cyberspace. It was cyberspace that gets more attention with every story or post of actors than ever before.

Prosecution is subject to the filing of a criminal complaint

Yesterday, Massoud Saytashi, a spokesman for the judiciary, said on the issue of sexual assault by some actors: “If these issues occur, they can be filed in the form of a criminal complaint and we will investigate these decisions and make a decision.”

Referring to the registration of only one complaint in this regard, the spokesman of the Judiciary continued: “Currently, a complaint has been filed regarding this issue, which we will address as soon as possible, and the necessary legal decision will be taken away from any fuss.”

Habib Rezaei restored his status

In this regard, a Fars reporter obtained information that “Habib Rezaei”, one of the accused, had complained about Shabnam Farshadjoo and Taraneh Alidosti through the me_too_movement_iran page. “Shabnam Farshadjoo” published a post using the images of the accused’s page, and Alidosti’s song was supported by Farshadjoo by republishing his story.

Dynamics also has a social dimension

Negative view of people towards the art community and artists is one of the most important aspects of the me too Persian movement.

With the view that the pioneering celebrities in this movement are seeking to restore the rights and purify the artistic community, the question arises as to why no complaints have been registered by these artists so far and they are not seeking the punishment of the victims according to their claims!

This lack of legal prosecution creates the suspicion that some of these celebrities are pursuing other goals and others have blindly followed the wave created.

It seems that the clarification of this issue and its margins is in the hands of the public prosecutor, so that in the process, the people’s view of the artistic community and their credibility and the reputation of our country’s artists will not be harmed.
