Khazali added: “The drafting and ratification of the Convention on the Rights of the Child reflects the concerns of the international community in the field of children’s rights that the Islamic Republic of Iran has also conditionally acceded to this international treaty, provided it is in accordance with Islamic standards.”
He added: “Considering the belief in monotheism, the holy law of Islam and paying special attention to Islam in Muslim childbearing, generational purity, good upbringing of children, their material and spiritual growth and development, and believing that the family is the main pillar of society in nurturing and The physical and mental, emotional and spiritual development of the child is considered and has a primary and fundamental responsibility in this regard; The National Document on the Rights of the Child and Adolescent was drafted in accordance with the Islamic perspective, the details of which will be announced below.
The head of the Cultural and Social Council of Women and Family of the Supreme Council of the Cultural Revolution, referring to the various articles of this document, said: The right to recreation, play and sports is an article of cultural, educational and training law, an article of economic law, an article of judicial law, an article of the right to security and an article of the rights of children of religious minorities.
He went on to explain some of the clauses of these articles: for example, in the article definitions on the subject of growth, maturity, laws and regulations, expediency, legal guardian, standards, health justice, sexual harassment, sexual disorders, intellectual property ownership, Legal capacity, criminal liability, civil liability are addressed.
Explaining the article on children and adolescents, Khazali said: “According to the present document, the child means any human being who has not reached the age of puberty, and the adolescent means an adult who has not reached intellectual development in accordance with his special rights and duties according to law.” This definition does not include marginalized adults.
He pointed out about the right to life and survival: Life is a divine gift that must be supported from the beginning of the formation of the fetus; No one should infringe on the right to life and health of the child and adolescent fetus, and the necessary measures should be taken to prevent and counter this plan; This clause emphasizes that abortion is prohibited unless the mother’s life is endangered, or before 4 months despite the embarrassment, if the fetus is preserved at the discretion of the competent authorities and in accordance with the law.
The head of the Cultural and Social Council for Women and the Family of the Supreme Council of the Cultural Revolution said about the child’s right to identity: Children and adolescents are also free to use the language, dialect, cover and practice ethnic and local customs and traditions in accordance with Islamic norms, laws and national cohesion.
Explaining the article on family law, he said: “The government is obliged to take all necessary measures and support for the benefit of children and adolescents from a legitimate, legal and worthy family, and to protect the family against the grounds of weakness, disorder and disintegration.” To support the care and development of children and adolescents in the family in the form of its capacities and resources.
Khazali clarified: custody of children and adolescents is the responsibility of parents. In addition, children and adolescents have the right to “be a family” and should not be separated from their families, except in cases where it is at the discretion of the competent court and with due regard to their interests and envy.
He stated that the right to health also means that children and adolescents have the right to maintain physical and mental health, as well as the standard of health and healthy living and the necessary facilities for the treatment of disease and rehabilitation, he added: In addition, parents and the government They should take appropriate measures to take care of the pregnancy and to maintain the health of the fetus and to prevent its aggression and damage.
The head of the Cultural and Social Council of Women and Family of the Supreme Council of the Cultural Revolution stated in the definition of the article of judicial law: In this article, a child has no criminal responsibility before reaching puberty, but no civil liability if he harms others. Or, for example, children and adolescents are equal before the law regardless of their gender, ethnicity, social and economic status or that of their family.
Referring to the importance of the rights of children of religious minorities, he said: “Children and adolescents belonging to all religious activities recognized in the constitution, have the right to freedom, religious ceremonies and education, and matters related to their religion within the law.” Also, all agencies related to children and adolescents’ affairs, in accordance with the duties of the agencies and the organization, should implement the provisions of this document by adopting legal measures, decisions and planning regarding them.
