According to Mehr reporter, all employees subject to the labor law, who are known as “workers” according to the definition of this law, are entitled to Eid and year-end bonus. This group’s holiday is different from the amount of holiday for executive and government employees and it is different according to the amount of “basic salary”.

The basis of workers’ Eid payment, if they have a history of paying insurance premiums for a full year at their workplace, the maximum (workers’ Eid ceiling) is 12 million 539 thousand 250 Tomans and the minimum (workers’ Eid floor) is 8 million 359 thousand 500 Tomans

Workers who have paid insurance premiums for less than one year, i.e. from one to 11 months, are entitled to a year-end holiday. This category of workers receive an Eid in the amount of “twice the basic salary listed in the pay slip, divided by 12, multiplied by the number of months of work”.

For example, a worker who receives the minimum salary approved by the Ministry of Labor in 1401, i.e. 4 million 179 thousand 750 tomans, and has one month of work experience, according to the Eid calculation formula, should receive 696 thousand 625 tomans, and a worker who earns the same basic amount salary, he has 11 months of work experience, he should receive 7 million 662 thousand 875 Tomans. It is emphasized that the calculated amount of holiday is only for workers who receive “minimum salary of 1401” and in other words are in the first year of entering the labor market.

The allowance of other employees with more than one year of experience, whose basic salary is definitely more than the “approved minimum salary”, will also be according to the mentioned formula, with the difference that the basic salary included in the pay slip will be the basis for calculating their allowance. In other words, if the base salary is 5 million tomans, this number should be included in the formula and calculate Eid.

Workers’ holiday and bonus are usually deposited by employers along with February salaries, but there is no legal prohibition to deposit it with March salaries either.

Also, to calculate the years of 1401, we must multiply the worker’s basic salary by the number of working days in a year. The number obtained is divided by 365 days of the year and the final number is the number of years of service at the end of the year 1401.

In the table below, the amount of Eid for minimum wage workers (those whose base salary is 4,179,750 tomans) is calculated in proportion to the number of months of work.

Workers who are out of a job, get a holiday for the months of work

Based on this, there are workers who have lost their jobs willingly or unwillingly due to various reasons such as the economic crisis of the employer, lack of need, etc. They are also entitled to receive a year-end holiday.

In accordance with what is stated in the labor law, this category of people receive an annual holiday and bonus in proportion to their working time; For example, a worker who is unemployed after working for 4 months must receive an Eid in proportion to the same 4 months of work, and the employer is obliged to pay this amount.

Eid payment to part-time, seasonal and hourly workers

Also, according to Article 39 of the Labor Law, the wages and benefits of workers who work part-time or less than the legally determined hours are calculated and paid in proportion to the hours worked.

In the case of hourly workers who do not have a fixed monthly salary and their salary varies per month, the average salary of the last three months of their service is used as the basis for calculation of Eid and bonus.

The amount paid for holidays and bonuses to workers of seasonal workshops covered by the labor law, as well as workers of other covered workshops who worked in the workshop for less than one year, should be calculated on the basis of 60 days and in proportion to their working days in a year.

Probationary workers also get a holiday

On the other hand, some workers are employed on a trial basis based on Article 11 of the Labor Law And its note, the duration of the trial period must be specified in the employment contract; If the employment relationship is terminated by the employer, he will be required to pay all the salaries of the trial period, and if the employment relationship is terminated by the worker, the worker is entitled to receive all the wages and benefits for the duration of the work.

Therefore, according to the labor law, this group of people is also eligible to receive all legal rights and benefits, including holiday and year-end bonus.

Sick leave is included in Eid

Also, according to Article 74 of the Labor Law, the period of sick leave that has been approved by the Social Security Organization is considered among the workers’ work records, so the said days will be subject to the payment of benefits such as children’s rights, pension rights, years of service, merit and holiday leave, and annual bonuses. was to be paid by the employer.
