There is no serious determination to confront the staging in the insurance industry

“Staging” is an act in which some profiteers receive damages from insurance companies in order to earn illegal income by creating fake accident scenes. This issue has become so common in today’s world that even stories and serious and humorous films have been written for it.

In the insurance industry, there has always been the issue of staging, and in a way, some experts believe that it can never be eliminated, but with careful measures and the right strategies, abuse in staging can be minimized.

Staging is possible for a variety of reasons. First of all, it should be said that it is implemented due to the shortcomings of the instructions and the weakness of the systems. In fact, people who turn to this method are aware of the legal vacuum and therefore can achieve their goals.

There are many ways to do this. One of the most important issues that is also operational in Iran is the issue of insurance-oriented personality. Because in this case, identifying high-risk people and, if necessary, in addition to making insurance more expensive, increases the likelihood of identifying them if they are guilty, but this position is certainly not the only solution and violators will be able to find a new solution. Another way to do this is through software and systems that are designed to more accurately convey the subject of information and information accuracy.

On the other hand, it should be said that the crimes that are intended for such violations are not enough and people take the risk of serious injuries as well as the possibility of being convicted of the offense. For this reason, there is a need for consensus between the government, the judiciary and the parliament in order to take basic measures to improve the situation.

According to Article 2 of the Islamic Penal Code adopted in 1992, “any behavior, whether an act or omission for which punishment is prescribed by law, is a crime.” Also, in the sixth part of the law on compulsory third party insurance approved in 2016 under the title of criminal regulations, the legislator criminalized the issue under Article 61 and stipulated that anyone commits fraudulent acts such as formal staging of an accident, car replacement or intentional damage. Receives funds for damages and is sentenced to sixth degree imprisonment (imprisonment for more than 6 months to 2 years) and a fine equal to 2 times the funds received. But the fundamental question is, despite the measures, what is the percentage of offenders trapped? Because allocating 15% of accidents to staging is a big number in the insurance industry.

According to some experts, if the claim is true that many people perform every year to earn money and their turnover reaches more than billions of tomans; It is a big problem that requires a working group of insurance companies, the parliament and the police, and if these institutions do not get involved in this issue with a new one, the issue of staging in Iran will never be eliminated. In developed countries, people are much less able to stage because of the rigors of verification.
